TERMS OF SERVICE
A small contract for shipping software.
These terms describe the business relationship between the Small operator and each customer using the control plane, runtime software, command-line tools, and agent interfaces.
Operator and agreement
Small is a business service operated by the Small operator. By creating or using a workspace on behalf of an organization, you confirm that you can bind that organization to these terms. Small is not offered to consumers.
The legal operator, registration number, postal address, governing law, and legal and privacy contacts have not yet been activated. Production validation will fail until every value is supplied.
The service
Small accepts a constrained deployment declaration, schedules workloads on connected runtime nodes, manages application ingress, and exposes deployment operations through its dashboard, API, CLI, and MCP interface. Features identified as alpha, preview, or experimental may change or be withdrawn.
The customer remains responsible for the applications it deploys, their behavior, availability requirements, dependencies, licenses, and compliance obligations. Small is not an AI model and does not verify that agent-generated code is correct or safe.
Accounts, agents, and access
Customers must provide accurate account information, protect credentials, configure roles according to least privilege, and remove access that is no longer required. Actions performed through a customer's users, service accounts, coding agents, or API tokens are treated as customer-authorized unless promptly reported as compromised.
Customer content and data
Customers retain ownership of their source, images, configurations, secrets, application data, and other content. They grant Small only the rights needed to host, transmit, back up, secure, and otherwise operate the service. Customers must have the rights and lawful basis needed for everything they deploy or submit.
Where Small processes personal data on a customer's behalf, the applicable data processing addendum governs that processing. The final addendum must be published before commercial launch.
Acceptable use
Customers must not use Small to break the law; violate intellectual property or privacy rights; distribute malware; conduct unauthorized security testing; facilitate abuse, fraud, harassment, or exploitation; disrupt the service or third parties; evade usage limits; or attempt to access another customer's data or resources. Small may investigate and restrict activity where reasonably necessary to protect the service, customers, or others.
Fees and taxes
Paid plans, included usage, overages, billing intervals, and currency are shown at checkout or in an order form. Fees are exclusive of applicable taxes unless stated otherwise. Subscriptions renew for the stated interval until cancelled. Except where law or an order form requires otherwise, amounts already charged are non-refundable.
Availability and changes
Small will use reasonable care to operate the service, but no availability SLA applies unless an executed order form says so. Maintenance, security events, provider failures, customer configuration, and preview features may affect availability. Material changes to effective terms will be announced through the service or account contact before they take effect.
Suspension, termination, and exit
Either party may end a subscription according to its order terms. Small may suspend access for material breach, security risk, unlawful use, or overdue payment, using notice where reasonably practicable. Customers should export configuration and history before termination. Small may delete remaining data after the applicable retention period, subject to legal obligations and the data processing addendum.
Intellectual property
Small and its licensors retain rights in the service, documentation, and runtime software. No rights are granted except those needed to use the service under these terms. Feedback may be used without restriction or obligation, provided it does not identify the customer or disclose confidential information.
Warranties and liability
To the extent permitted by law, the service is provided as available and implied warranties are disclaimed. Neither party is liable for indirect, incidental, special, punitive, or consequential loss, or lost profits, revenue, or data. Each party's aggregate liability under these terms is limited to fees paid or payable for the service during the 12 months before the event giving rise to the claim.
These exclusions and limits do not apply where liability cannot lawfully be limited, or to fraud, wilful misconduct, breach of confidentiality, infringement by customer content, or payment obligations.
Privacy and confidentiality
Each party must protect the other party's non-public information using reasonable care and use it only for this relationship, except where disclosure is legally required. Small's processing as controller is explained in the Privacy Notice, and its service providers are listed on the Subprocessors page.
Law and contact
Governing law, venue, notice mechanics, and the operator contact remain deliberately unset while this is a working draft.
